Vanuatu Enacts Legal Framework for Virtual Assets

Vanuatu has officially established a legal framework for cryptocurrencies with the recent passage of the Virtual Asset Service Provider (VASP) Act by its Parliament last week. The new legislation defines virtual assets as "digital representations of value that may be traded and function as a medium of exchange, a unit of account, or a store of value."

According to an official announcement, the legislation, however, specifically excludes digital representations of fiat currencies, securities, and national digital currencies, including central bank digital currencies (CBDCs). The government clarified that despite the new regulations, cryptocurrencies will not be considered legal tender within the country.

The Vanuatu Financial Services Commission (VFSC), which initiated efforts in this area years prior, will be the regulatory body overseeing the local cryptocurrency industry. In a press release, the VFSC acknowledged that virtual assets and cryptocurrencies possess "value" due to their exchangeability for other valuable assets, albeit reliant on market dynamics.

The new legal framework aims to ensure compliance with international standards, including the Financial Action Task Force's (FATF) "travel rule" policy. Vanuatu anticipates that this development will unlock "numerous opportunities... both economically and socially." The announcement further stated that "Economically, the VASP Act establishes a stable regulatory framework for digital business transactions," which is expected to foster competition, attract investment, reduce business costs, and enhance consumer protection. The government also highlighted the potential for greater speed, lower costs, and increased efficiency in virtual asset transactions, including cross-border payments, potentially improving financial inclusion. This move aligns Vanuatu with other offshore jurisdictions like the Cayman Islands, which recently updated its crypto regulations, as both aim to attract cryptocurrency businesses.
