Binance Contests India's $86 Million Tax Showcause Notice

Binance is currently contesting an $86 million tax showcause notice from India's Directorate General of Goods and Services Tax Intelligence (DGGI). The notice, issued by the DGGI's Ahmedabad chapter, alleges that Binance failed to pay taxes on fees collected from Indian customers trading on its platform from July 2017 to March 2024.
The DGGI, which functions under the Ministry of Finance and is responsible for managing indirect tax evasion intelligence, has issued this notice as part of its mandate to address potential tax evasion. The DGGI's action follows a pattern of regulatory pressure on cryptocurrency firms in India, as demonstrated by Binance's recent $2.2 million fine in June 2024 for non-compliance with anti-money laundering regulations. However, Binance had earlier secured approval from India's Financial Intelligence Unit (FIU) as a registered entity, indicating its commitment to adhering to local regulations.
Binance has responded to the showcause notice by expressing full cooperation with Indian authorities and reaffirming its adherence to applicable domestic laws. A Binance spokesperson emphasized the company's dedication to legal compliance and transparency. The DGGI's investigation into Binance is independent of the FIU's earlier review and is specifically focused on Online Information and Database Access or Retrieval Services (OIDAR), which are delivered over the internet. The categorization of these services aims to ensure fair competition between international and domestic service providers.
