CFTC Issues No-Action Relief for Bitnomial’s US Prediction Markets

Under the letter, Bitnomial is exempted from certain reporting requirements that normally apply to asset swaps. These rules were originally designed for traditional derivatives markets and are widely viewed as difficult to apply to prediction markets, where large volumes of small, short-duration contracts can trade within a single day. The relief allows Bitnomial to operate without adopting compliance systems built for lower-frequency markets, while remaining within the CFTC’s regulatory perimeter.

The exemption comes with conditions. Bitnomial must publish consumer-facing data on its website, including timestamps and sales information for each contract market. The platform is also required to provide detailed market data directly to the CFTC upon request, maintaining regulatory oversight despite reduced routine reporting.

The letter also preserves strict risk controls. All positions on Bitnomial’s platform must be fully collateralized, meaning leverage is not permitted and each contract must be backed one-to-one. The CFTC has positioned this requirement as a safeguard to ensure liquidity and limit the risk of forced liquidations during volatile periods. The structure aligns with the design of prediction markets, where contracts typically settle quickly and are tied to binary outcomes.

The decision comes as prediction markets gain broader acceptance in the US. Interest increased during the 2024 election cycle, when supporters argued that market-based forecasts often tracked outcomes more closely than opinion polls. Since then, event-based trading has expanded into areas such as sports, economics, and other real-world outcomes. Platforms including Polymarket and Kalshi have attracted both public attention and institutional interest, with Intercontinental Exchange investing $2 billion in Polymarket in October 2025 at a reported $9 billion valuation.

Bitnomial is entering an increasingly competitive landscape that includes crypto-native platforms and traditional financial institutions. Coinbase agreed in December to acquire prediction market startup The Clearing Company, a deal expected to close in January 2026. With US midterm elections scheduled for the same year, trading volumes in prediction markets are widely expected to rise.

While the no-action letter applies specifically to Bitnomial, it signals a more flexible regulatory approach to prediction markets built on modern infrastructure. Other platforms are likely to study the decision as a reference point for navigating US regulatory requirements without being constrained by frameworks designed for older derivatives markets.
