CFTC Seeks Extension in KuCoin Lawsuit Amid Settlement Discussions

The Commodity Futures Trading Commission (CFTC) has filed a status report regarding its lawsuit against the operators of KuCoin, an offshore digital asset exchange. The CFTC informed the New York Southern District Court on December 1, 2025, that discussions between the parties have resumed.

The regulator cited a shutdown and its impact on Commission processes as a reason for delays in these discussions. Both parties are requesting a 60-day extension to file an updated status report, allowing for further engagement and a more substantive update.

In March 2024, the CFTC initiated a civil enforcement action in the U.S. District Court for the Southern District of New York. The complaint named Mek Global Limited, PhoenixFin PTE Ltd., Flashdot Limited, and Peken Global Limited, entities that collectively operate KuCoin.

The lawsuit alleges multiple violations of the Commodity Exchange Act (CEA) and CFTC regulations. Specific charges include illegally dealing in off-exchange commodity futures transactions and leveraged, margined, or financed retail commodity transactions. Additionally, the CFTC claims KuCoin solicited and accepted orders for commodity futures, swaps, and leveraged, margined, or financed retail commodity transactions without registering as a futures commission merchant (FCM).

Further allegations include failure to diligently supervise FCM activities, operating a facility for the trading or processing of swaps without registering as a swap execution facility (SEF) or designated contract market (DCM), and failing to implement an effective customer identification program (CIP).
