CFTC Takes Action Against Vitol for Exceeding Federal Position Limits

The Commodity Futures Trading Commission (CFTC) has announced a significant enforcement action against Vitol Inc., headquartered in Houston, Texas, and its affiliate Vitol SA, based in Geneva, Switzerland. The CFTC has imposed a $500,000 civil monetary penalty on Vitol for exceeding federal position limits on crude oil and live cattle futures contracts. This enforcement action marks the first time the CFTC has utilized its authority to enforce position limits on aggregate positions across multiple exchanges.
The order issued by the CFTC requires Vitol to cease and desist from further violations of the Commodity Exchange Act and CFTC regulations. The findings reveal that on multiple occasions in 2022, Vitol held positions in excess of federal speculative limits. Specifically, on May 17, 2022, and June 16, 2022, Vitol's positions in financially-settled options on crude oil futures exceeded the federal limits by as much as 1,594 contracts. Additionally, on December 5, 2022, Vitol's holdings in CME Live Cattle Futures contracts surpassed the federal limit by 171 contracts.
Ian McGinley, Director of Enforcement at the CFTC, emphasized the importance of position limits, stating, "Federal position limits are important and are in place to prevent this sort of manipulation. Today's action shows the CFTC will use its ability to look at positions on and across exchanges to enforce compliance and protect the integrity of the futures markets."
