Coinbase Challenges SEC Over Crypto Regulations in Appeals Court

Coinbase has accused the U.S. Securities and Exchange Commission (SEC) of neglecting legal obligations regarding cryptocurrency regulation. In a recent filing with the U.S. Court of Appeals for the Third Circuit, Coinbase alleges the SEC's refusal to establish clear guidelines for digital asset regulation constitutes a violation of the law.
According to Coinbase's legal team, the SEC has failed to fulfill its duty by neither drafting nor implementing comprehensive regulations governing crypto assets. Instead, the company argues, the SEC relies on sporadic enforcement actions, creating uncertainty within the industry.
The U.S SEC denied a petition by Coinbase Global seeking new rules from the agency for the digital asset sector in December 2023, which is criticized by the country's largest crypto exchange, citing a lack of substantive explanation. The company's chief legal officer, Paul Grewal, asserts the public's right to transparency regarding the SEC's regulatory decisions.
"if you go back and read the SEC's perfunctory denial, you'll be hard pressed to find an actual reason for its inaction," he said.
The lawsuit contends that the SEC's regulatory approach imposes unclear standards while failing to provide guidance or a pathway to compliance. The ongoing legal challenge highlights Coinbase's dissatisfaction with the SEC's regulatory tactics.
While distinct from Coinbase's broader legal battle with the SEC, both cases underscore the regulator's reluctance to define crypto securities definitively.
