GAIN Capital Secures Swiss Court Approval for Deposition in OANDA Patent Lawsuit

GAIN Capital Holdings, Inc. and GAIN Capital Group, LLC announced on June 17, 2025, that they have secured approval from a Swiss court for judicial assistance in a patent infringement lawsuit brought by OANDA Corporation. This development was communicated to the New Jersey District Court.

The High Court of Zurich and the Federal Office of Justice (FOJ) in Switzerland have approved GAIN Capital's Letter of Request to depose Dr. Richard Olsen, a listed inventor on the patents central to the lawsuit, in Switzerland. OANDA Corporation initiated the lawsuit, alleging infringement of two United States Patents related to trading currencies over a computer network.

GAIN Capital is seeking evidence and testimony from Dr. Olsen to support its defenses of patent invalidity and unenforceability, and to challenge OANDA's claim for damages in the ongoing proceedings and at trial. Dr. Olsen is required to provide testimony concerning the asserted patents on matters directly relevant to the case. GAIN Capital is currently coordinating with OANDA's legal counsel to schedule the deposition promptly.
