d51d4ffe17c36bcab75cdceca994a44.jpegHSBC Securities (USA) Inc. has consented to pay a $125,000 fine as part of a settlement reached with the Financial Industry Regulatory Authority (FINRA) due to several regulatory breaches.

Between June 2020 and March 2022, the firm failed to report approximately 5,635 transactions related to TRACE-eligible corporate debt securities in a timely manner, violating FINRA Rules 6730(a) and 2010. This oversight raised significant compliance concerns regarding the firm's reporting practices.

Moreover, HSBC Securities has been found lacking in its supervisory framework. From June 2020 to the present, the firm did not establish or maintain a supervisory system that included adequate written procedures designed to ensure adherence to TRACE reporting requirements, in violation of FINRA Rules 3110 and 2010.

In addition to the financial penalty, the settlement includes a formal censure. HSBC Securities must also ensure that a senior management member, who is a registered principal, certifies in writing that the firm has addressed the identified issues. This certification will confirm that they have implemented a supervisory system with written procedures aimed at achieving compliance with Rule 6730.

This settlement underscores the importance of robust compliance mechanisms in the financial services industry, particularly concerning transaction reporting. HSBC Securities is now tasked with revising its supervisory practices to prevent future violations and enhance its regulatory adherence.
