Changpeng Zhao (CZ) is finally behind bars.

Over the past year, the legal battle between Binance's founder and the U.S. government has dominated crypto news headlines. Following the 2022 FTX liquidity crunch​ and the dramatic arrest of its founder, Sam Bankman-Fried (SBF), after fleeing to the Bahamas, many speculated that CZ would face a similar fate. However, unlike SBF, CZ, though incarcerated, will be released after just four months. I mean, he can even catch up Thanksgiving with his family.

From Crypto Billionaire to Inmate

Born in China in 1977, CZ emigrated to Vancouver, Canada, with his family in 1989. Entering the blockchain industry in 2013, he quickly set his sights on cryptocurrency. He founded Binance in 2017, turning it into the world's largest crypto exchange within just eight months. CZ himself was ranked third in Forbes' "The Richest People In Cryptocurrency" list. By 2021, with a net worth of $90 billion, he became the richest ethnic Chinese person as well as one of the top ten richest individuals globally.

However, as the value of Bitcoin peaked in 2021, CZ's fortunes appeared to follow the volatile path of this token.

According to Fazzaco, in March 2023, Binance was hit with a lawsuit by the Commodity Futures Trading Commission (CFTC) for illegal operations in the U.S. and non-compliance with regulations aimed at preventing money laundering and other illicit activities. The CFTC also named Binance's founder and CEO, Changpeng Zhao, and former chief compliance officer, Samuel Lim, as defendants.

In June 2023, the U.S. Securities and Exchange Commission (SEC) filed 13 charges against CZ and Binance entities, alleging a web of deception, conflicts of interest, lack of disclosure, and calculated evasion of the law.

By November last year, CZ and the U.S. government reached a settlement, with Binance agreeing to pay a $4.3 billion fine and him personally paying a $50 million fine. This resolved the longstanding investigations into Binance, and he stepped down as CEO. However, despite formally severing ties with Binance, CZ still holds a majority stake, effectively maintaining control over the giant exchange.

In April 2024, CZ was sentenced to four months in prison on money laundering charges, a sentence significantly lighter than the three-year term sought by U.S. federal prosecutors. Just a few days ago, on June 2, CZ reported to a low-security federal prison in California, as confirmed by his lawyers. Therefore, he is likely to be released by October this year.

SBF Gets 25 Years and CZ Only 4 Months, Why the Difference?

Remember the 2022 FTX crisis? Fazzaco, in an article outlining the liquidity crunch timeline, detailed how the two crypto firms transitioned from partners to competitors. It noted how CZ, then CEO of Binance, tweeted about Binance selling all their FTT holdings, equivalent to $2.1 billion USD in cash, which escalated the crisis.

On March 28, 2024, SBF was sentenced to 25 years in prison, while CZ received only four months just a month later. Additionally, CZ reported to a low-security prison with inmates posing minimal security risks, unlike SBF, who is incarcerated in a more volatile federal prison in New York. However, Cointelegraph reported on June 4 that SBF might be transferred to a California prison.

So why did CZ receive a much lighter sentence compared to his FTX bro? There are three main reasons.

First, CZ turned himself in and cooperated fully with the investigation, unlike SBF, who fled to the Bahamas. Furthermore, CZ has a stable family and needs to care for his minors, which weighed in his favor during sentencing.

Second, Binance's agreement to pay the $4.3 billion fine mitigated the severity of his legal consequences.

Lastly, the judge considered his previously clean criminal record and his public expression of regret for his unlawful actions during sentencing.
