UK FCA Reopens Retail Access to Crypto ETNs Under Stricter Rules

Retail investors in the United Kingdom can once again gain exposure to crypto exchange-traded notes (cETNs) after the Financial Conduct Authority (FCA) lifted its previous ban on the products. The regulator's decision marks a shift in the country's stance toward digital asset investments, though the renewed access comes with stringent consumer protection requirements.

According to the FCA, cETNs will now be treated as Restricted Mass Market Investments, bringing them under the UK's financial promotion rules. This classification means firms must comply with a series of obligations, including conducting appropriateness tests, applying "cooling-off periods," issuing prominent risk warnings, and avoiding investment incentives.

The FCA emphasized that firms must "act in good faith, avoid foreseeable harm, and support customers' financial objectives" under its Consumer Duty framework. Companies will also be expected to clearly define their target markets, design products that align with investors' needs, and ensure fair value assessments are part of their oversight processes.

To qualify for retail distribution, crypto ETNs must be listed on the FCA's Official List and traded on a UK-recognized investment exchange. The regulator noted it had reviewed product prospectuses ahead of the October 8 policy change to enable a quicker rollout of compliant offerings.

Firms seeking to offer cETNs are encouraged to engage with the regulator early through pre-application meetings. The FCA also continues to advance broader crypto regulation, having recently launched a consultation on how its Handbook should apply to crypto-related activities and published a roadmap outlining plans to bring the sector within its supervisory perimeter.

While the return of cETNs creates new opportunities for financial firms, the FCA's heightened focus on consumer safeguards suggests that access will be tightly controlled. The regulator's approach aims to balance market innovation with the need to reduce investor harm in the fast-evolving digital asset space.
